Erso Capital Launches Second Global Litigation Fund Across Key Sectors 

London, UK / California, USAErso Capital, an active player in the global litigation finance market, is proud to announce the launch of its second global litigation fund, building on the success of its inaugural 2021 fund.  The new fund will continue to build on the diverse global portfolio of high-value commercial litigation and arbitration disputes, with increased investment in key areas of patent litigation, ESG and mass claims. 

Erso Capital has successfully navigated the complexities of a challenging financial landscape over the past 18 months, during which many funds in the litigation finance sector have scaled back or ceased new investments. Despite this, Erso Capital has not only sustained its position but has thrived, securing ongoing support from its institutional investors and expanding its investment pipeline.

Fund 1 Highlights 

Erso’s Capital Inaugural Fund 1 closed its investment period at the end of 2024 with a diverse portfolio of investments, including commercial litigation and arbitration, law firm portfolio financings (both WIP financing and book-building capital), patent disputes, competition and antitrust claims, mass consumer disputes, investment treaty arbitrations, and significant capital deployments in judgment monetizations. 

Fund 2 - A Flexible Investment Approach for Diverse Opportunities 

Erso’s new fund is designed with maximum flexibility to target a broad range of litigation finance opportunities. The fund will support investments in individual cases requiring capital commitments typically between USD $1M and $25M, as well as larger portfolio investments ranging from USD $10M to $300M

Alongside its core fund, Erso Capital will continue expanding its patent investment portfolio, which is supported by a separate dedicated capital facility. “Patent litigation has been a major focus for Erso, and we see significant growth potential in this sector moving forward. We plan to substantially increase our capital commitments during this cycle and look forward to collaborating with leading patent litigators to deploy this capital,” said James Blick, Co-Founder of Erso Capital, based in California. 

Broadened Investment Mandate 

Erso also aims to broaden its footprint in the mass claims sector (including toxic tort and other ESG disputes, mass torts and consumer protection, securities and antitrust litigation).  

Erso sees potential for future innovation, including through leveraging its strategic alliances with leading litigation insurance specialists, TheJudge Group. This unique alliance enables Erso to combine capital with tailored insurance options, optimizing financial outcomes for law firms and their clients.  The team have also seen an increasing pipeline of law firms seeking to refinance existing or outdated capital arrangements.
